A judge ruled in favor of the Stouts on all counts in the unlawful detainer trial held yesterday.

Judge Thomas Wm. Cain, presiding in Department 3 of the Santa Clara Superior Court, refused to allow Ed Dennis’ attorney to present what Todd Rothbard, representing the Stouts, referred to as a soap opera, declaring that these are summary proceedings. Stephen Levy, representing Dennis, had hoped to address breach of contract allegations, but Cain said such matters must be dealt with in separate civil action. Cain ordered restitution of the property and awarded $54,000 in rent to the Stouts.

Todd Rothbard represented the Stouts and suffered no apparent setbacks in asserting that Dennis had nothing more than a verbal contract.

Dennis must move within five days of the time the sheriff “posts” the property. Brad Chibos, another lawyer who has assisted the Stouts substantially, said this would likely occur Monday or Tuesday.
